In a move that’s stirring frustration across the country, a federal judge just stepped in to block President Trump’s administration from shutting down a controversial Biden-era immigration program that’s allowed hundreds of thousands of migrants from Cuba, Haiti, Nicaragua, and Venezuela to remain in the U.S.
The ruling came down Monday from U.S. District Judge Indira Talwani, who issued a 41-page decision stopping the Department of Homeland Security from revoking parole protections that were set to end on April 24. The migrants entered under Joe Biden’s so-called “humanitarian parole” program, which many experts — and Americans — say was unlawfully created and ripe for abuse
Let’s be clear: Biden launched this program unilaterally, without Congress. Using a broad interpretation of executive parole authority, his administration opened the door for hundreds of thousands of people from four countries — Cuba, Haiti, Nicaragua, and Venezuela — to bypass normal immigration procedures.
Many entered without proper vetting. Many were released into American cities with work authorizations. And according to Fox News’ Bill Melugin, the program was “temporarily halted due to fraud.”
And yet, this week, a judge decided that President Trump — despite being elected to restore law and order — can’t stop it.
Judge Talwani claimed that while Homeland Security Secretary Kristi Noem has wide authority over immigration policy, she can’t just revoke these parole grants without case-by-case review. In other words, Trump’s plan to end mass paroles and return immigration policy to the law has now been stopped in its tracks — at least temporarily.
Here’s what she wrote:
“The Secretary’s actions are not wholly shielded from judicial review… The plan to revoke parole and work authorizations without individual review oversteps those bounds.”
This flies directly in the face of the Trump administration’s position, which has argued that executive parole power has been abused under Biden and needs to be reined in — fast.
Progressive immigration activists wasted no time celebrating. Karen Tumlin, founder of the left-leaning Justice Action Center, praised the judge’s decision, saying:
“This ruling is a significant step toward justice… so many people throughout the country will be able to breathe a huge sigh of relief.”
That’s their version of “justice” — allowing mass parole for foreign nationals while American citizens struggle with crime, inflation, and a housing crisis fueled in part by the flood of migrants.
The Trump administration has been working aggressively to clean up the chaos left behind by the Biden White House. That includes:
- Ending mass catch-and-release.
- Tightening asylum loopholes.
- Prioritizing deportation for those who’ve broken U.S. immigration law.
The plan to cancel this parole program was just one part of that effort.
But now, thanks to this Boston-based federal judge, Trump’s Homeland Security team won’t be allowed to end a program that didn’t go through Congress, wasn’t debated publicly, and operated outside traditional immigration channels.
This decision will likely be appealed — and it could reach the Supreme Court depending on how far the administration takes it. But for now, the court has handcuffed the Trump administration, forcing the country to continue Biden’s controversial program… against the will of the people who voted for secure borders and restored sovereignty.
