Appeals Court Upholds Order for Trump Administration to ‘Facilitate’ Return of Kilmar Abrego Garcia

The legal battle over the deportation of an alleged MS-13 gang member has reached a boiling point, as the 4th U.S. Circuit Court of Appeals dealt another blow to the Trump administration’s efforts to protect American communities.

On Thursday, the court refused the Trump administration’s urgent request to lift a controversial federal judge’s order that demands the government “facilitate” the return of Kilmar Abrego Garcia—a man who was in the U.S. illegally and has now been deported back to El Salvador, where he’s being held in a high-security prison.

This all stems from an ongoing legal tug-of-war involving Abrego Garcia, who lived in Maryland but was deported under a Trump-era policy aimed at cracking down on gang violence, especially among foreign nationals. Immigration officials say Garcia is tied to the violent MS-13 gang and was involved in human trafficking. His lawyers and Democrat allies, of course, claim he’s just a family man caught in a government mix-up.

Back in 2019, an immigration judge ruled that Garcia couldn’t be deported to El Salvador due to potential persecution. Yet, under what’s being called an “administrative mistake,” he was still sent back. His legal team calls it a “Kafka-esque” error. The left is now using the case to question the Trump administration’s immigration enforcement and even, unbelievably, to push for impeachment.

After U.S. District Judge Paula Xinis reaffirmed her directive to return Garcia, the Trump administration appealed—arguing that forcing the U.S. to bring back a deported gang suspect undermines the president’s authority over foreign affairs and national security.

But in a surprise move, the 4th Circuit rejected the appeal—just one day after it was filed.

Judge J. Harvie Wilkinson, a Reagan appointee, authored the decision and dismissed the administration’s appeal as “extraordinary and premature.” He made the remarkable claim that the administration was acting as if it had the right to “stash away residents of this country in foreign prisons without the semblance of due process.”

Even more concerning to many conservatives, Wilkinson seemed to suggest that the federal government lost its authority over Garcia the moment he was deported—completely ignoring the very real national security concerns involved.

Press Secretary Karoline Leavitt hasn’t minced words about who Abrego Garcia really is.

“The administration maintains the position that this individual — who was deported to El Salvador, and will not be returning to our country — was a member of the brutal and vicious MS-13 gang,” Leavitt said.

She laid out the facts:

“Fact number one, he was part of MS-13.
Fact number two, we have credible intelligence showing he was involved in human trafficking.
Fact number three, he was a leader in this gang — which this president has designated as a Foreign Terrorist Organization.”

Leavitt also slammed activist judges for overstepping their boundaries and trying to force the executive branch into foreign policy decisions. She reminded Americans that it’s the president—not the courts—who is constitutionally empowered to conduct foreign affairs.

After two rejections from the 4th Circuit, the Trump administration may now take its fight to the Supreme Court and seek emergency relief.

This isn’t just about one deported individual—it’s about presidential authority, national security, and whether activist courts can force the U.S. government to bring dangerous foreign nationals back onto American soil, even when there’s credible evidence of gang affiliation and human trafficking.

Abrego Garcia and his family, as expected, deny any ties to MS-13. But that’s a claim the Trump administration—and law enforcement in Maryland—flatly reject.

The left continues to wrap this case in emotional appeals and courtroom drama, painting Garcia as a victim while ignoring the serious concerns tied to MS-13’s violent reputation. But Americans know better. We’ve seen what happens when our leaders let down their guard on immigration enforcement.

This case isn’t just about one man. It’s about protecting our borders, upholding the law, and defending the right of the President of the United States to do his job without interference from rogue judges.

Let’s be clear: No judge should be forcing this country to reopen its doors to alleged gang leaders. And no president should be threatened with impeachment for doing what’s necessary to keep Americans safe.
