Democrats in Maine are charging full speed ahead with a plan that could permanently allow biological males to compete in female sports—enshrining it in the state constitution.
On Thursday, Maine’s Democrat-led House narrowly passed LD 260, a bill that would embed the Maine Human Rights Act (MHRA) into the state’s highest legal document. The bill now heads to the Senate, where it needs a two-thirds majority to advance to voters.
If passed, the move would codify controversial gender identity laws, prioritizing ideology over biological reality. Back in 2021, Democrats slipped “gender identity” into the MHRA. That single amendment opened the floodgates—letting males who identify as female into girls’ locker rooms, bathrooms, and athletic teams.
Despite federal law and growing backlash, Maine’s top law enforcement officer, Attorney General Aaron Frey, is unapologetic.
In a CNN interview, Frey claimed, “Our position is that Title IX… supports that trans girls will be able to participate in high school sports consistent with their gender identity.”
In other words, Maine’s leadership is defying President Trump’s executive order that bars male athletes from competing in female sports—a policy rooted in fairness, safety, and common sense.
The House vote came just one day after the U.S. Department of Justice sued Maine for its open refusal to enforce the Trump administration’s “Keeping Men Out of Women’s Sports” executive order.
The DOJ’s lawsuit pulls no punches:
“By prioritizing gender identity over biological reality, Maine’s policies deprive girl athletes of fair competition, deny them equal athletic opportunities, and expose them to heightened risks of physical injury and physiological harm.”
And President Trump didn’t mince words either.
At a Republican Governors Association dinner on February 20, Trump warned Gov. Janet Mills in front of the crowd:
“We are the federal law. You better do it, because you’re not gonna get any federal funding if you don’t. Your population also doesn’t want men in women’s sports.”
To which Mills flippantly replied, “See you in court.”
Trump’s comeback? “Good. See you in court, that should be a real easy one… Enjoy your life after, governor. I don’t think you’ll be in elected office.”
In the wake of Maine’s refusal to comply, both the U.S. Department of Education and the Department of Health and Human Services launched investigations into the state’s education system.
Their findings? Maine was in violation of Title IX.
Federal agencies have now started cutting off funding to the state’s public schools, with the Department of Education moving to slash K–12 funding. Even the USDA began freezing financial support—until a federal court stepped in temporarily.
This debate isn’t theoretical—it’s already happening. Earlier this year, a transgender-identifying male student won the girls’ pole vault championship in Maine’s Class B division, representing Greely High School.
That’s the future Maine Democrats are pushing: biological boys taking victories, scholarships, and opportunities away from girls.
Maine Republicans are now pushing legislation to strip “gender identity” from the Maine Human Rights Act altogether—seeking to restore clarity, fairness, and biological truth in the law.
With the future of women’s sports on the line, the battle in Maine may set a precedent for the rest of the country.
