House Judiciary Committee Chairman Jim Jordan (R-OH) is leading the charge to stop activist judges from weaponizing the courts against conservatives — and he’s got a plan to fight back.
During a candid and pointed interview on The Alex Marlow Show, Jordan unpacked how Republicans in Congress are taking concrete steps to rein in judicial overreach and put the power back where it belongs — with the American people and their elected representatives.
Alex Marlow kicked off the conversation by highlighting one particularly troubling case: U.S. Magistrate Judge Jessica Hedges’ decision to release a suspect accused of firebombing a Tesla dealership in Kansas City, Missouri. The suspect’s attorneys argued for release based on the suspect’s transgender status and diagnoses of ADHD and gender dysphoria — and Judge Hedges agreed.
This case, Marlow noted, is just the latest example of liberal judges putting ideology over law and common sense.
“There’s three avenues we have in the Congress,” Jordan explained. “We can pass legislation, we can do oversight, and we can draw attention to all the crazy things like you just highlighted.”
And Republicans are already taking action.
Jordan pointed to a key bill from Rep. Brian Mast (R-FL) that recently passed the House. The bill restricts federal district judges from issuing nationwide injunctions — something the left has used repeatedly to block Republican-led policies.
“This says if one of these federal district judges issues an injunction, it only applies to the parties in the case in that respective jurisdiction. It doesn’t apply nationwide,” Jordan said.
Even liberal Justice Elena Kagan supported this principle a few years ago, Jordan added.
Marlow noted how Democrats have leaned on activist judges like Marc Elias to interfere with conservative policies going back to 2008. Jordan wasn’t surprised.
“You’re underscoring this fundamental fight,” he said. “The left always says we trust the, quote, experts. And the experts, according to the left, are always the individuals who aren’t elected.”
Whether it’s Dr. Fauci, rogue judges, or bureaucrats deep in Washington, Jordan argued that Democrats are determined to bypass elected representatives and push their agenda through unelected “experts” who are never accountable to voters.
That, Jordan stressed, is exactly what our Founders were trying to prevent.
“If you don’t like what they do, you get a chance to throw them out every two years,” Jordan said. “That’s the fundamental fight.”
Another piece of the puzzle is stopping judges from forcing presidents to spend taxpayer dollars against their will.
Jordan explained how some federal judges have tried to override the Trump administration by ordering funds to be released — even when the president cut them off for good reason.
“That is not a decision for a federal district judge,” Jordan said. “That should go to the court that typically deals with that… and there’s a time frame, I think in the bill, it’s like 180 days to make that determination.”
Jordan believes there should be an expedited legal pathway to get such serious issues in front of the Supreme Court more quickly, before liberal lower courts can bog things down and twist the Constitution.
Jordan also emphasized the importance of shining a spotlight on this judicial overreach, especially through conservative media.
“I think we continue to do what you and I do,” he told Marlow. “We talk about this, because the more you highlight, the more everyone in the country… hears about this.”
He added that even judges pay attention to the public conversation. If they know their decisions are going to be exposed and scrutinized, they’re more likely to stick to the Constitution.
Jordan closed by praising the turnaround in the Department of Justice and FBI under the Trump administration’s second-term leadership, particularly Attorney General Pam Bondi and FBI Director Kash Patel.
“DOJ is night and day… with Pam Bondi and Todd Blanche and Kash Patel at [FBI],” Jordan said. “They’re no longer investigating parents at school board meetings and pro-life Catholics. They’re actually going after bad guys.”
Under Trump’s leadership, Jordan added, every agency now has someone in charge who understands they work for “We the People” — not the other way around.
