In yet another frustrating case of lawfare aimed at blocking President Trump’s immigration policies, a federal judge has temporarily stopped the deportation of over half a million illegal migrants — many of whom were flown into the country under Joe Biden’s controversial parole program.
This decision comes from U.S. District Judge Indira Talwani, an Obama appointee, who ruled Thursday to block the Department of Homeland Security (DHS) from moving forward with a plan to revoke Temporary Protected Status (TPS) for around 532,000 migrants from Cuba, Haiti, Nicaragua, and Venezuela.
These migrants originally entered the U.S. through Biden’s “CHNV parole program” — a backdoor immigration scheme that allowed hundreds of thousands of foreign nationals to skip the line and land on U.S. soil without going through traditional legal channels.
As previously reported by Breitbart News, the Trump administration had moved to end the parole program, citing its abuse and lack of legal basis. DHS issued a formal warning in March: migrants covered under the now-revoked program would have 30 days to self-deport — or face removal by law enforcement.
“DHS has determined that a 30-day wind-down period provides affected parties sufficient notice while also preserving DHS’s ability to enforce the law promptly,” the DHS statement read.
The plan was set to take effect on April 24.
But now, Judge Talwani is standing in the way.
In her ruling, Talwani argued that the administration failed to provide a “reasoned decision” when cutting short the parole period. She claimed that ending the program was based on “an incorrect reading of the law” — despite DHS following a legal review process to end what it deemed an unlawful immigration channel.
“There was a deal, and now that deal has been undercut,” Talwani said during the hearing.
The so-called “deal” she referenced? A parole program that Biden pushed through without Congress — and one that funneled migrants into the U.S. with promises of housing, healthcare, and welfare, all courtesy of American taxpayers.
This ruling is just one more roadblock as President Trump works to undo Biden’s open-border legacy. With over 21 million illegal migrants now estimated to be living in the U.S., the Trump team has made it clear: the era of mass amnesty is over, and it’s time to restore law and order.
White House Deputy Chief of Staff Stephen Miller, a key architect of Trump’s immigration policy, didn’t hold back in response to the ruling.
“These are the illegals that Biden flew by airplane en masse into the United States, including the Haitian migrants now occupying Springfield,” Miller wrote on X.
These are the illegals that Biden flew by airplane en masse into the United States, including the Haitian migrants now occupying Springfield. Biden gave these illegals free housing, healthcare and welfare. Now a local judge says they have to stay here for forever.
“Biden gave these illegals free housing, healthcare and welfare. Now a local judge says they have to stay here for forever.”
“NO,” he concluded bluntly.
This isn’t the first time Judge Talwani has made headlines for questionable rulings. In June 2023, she sided against a 12-year-old Massachusetts student who wore a T-shirt to school stating “THERE ARE ONLY TWO GENDERS.” According to Talwani, that expression violated other students’ supposed right “to be secure and to be let alone.”
So let’s be clear: this is a judge who will protect illegal migrants and radical gender ideologies — but not the free speech of American schoolkids.
While this ruling is a setback, it’s not the end of the fight. Legal experts expect the Trump administration to appeal the decision and continue its push to dismantle Biden’s parole program, which critics say was nothing more than a mass amnesty pipeline dressed up in bureaucratic language.
The ruling may delay deportations, but it also shines a spotlight on the lawlessness Biden unleashed. Americans are watching closely, and many are demanding answers — and action.
The Biden administration opened the floodgates with its parole scheme. Now, activist judges are trying to stop President Trump from shutting them. But the American people are wide awake — and they’re ready to stand behind a leader who puts law, order, and American sovereignty first.
