In a bold move to defend President Donald Trump’s efforts to crack down on illegal immigration, Rep. Brandon Gill (R-TX) has filed Articles of Impeachment against federal Judge James E. Boasberg, an Obama appointee. The move comes after Boasberg issued a temporary restraining order that blocked Trump from using the Alien Enemies Act to deport illegal alien gang members.
The Battle Over Deportations
Over the weekend, President Trump took decisive action against violent criminal organizations operating within U.S. borders. He invoked the Alien Enemies Act to begin the immediate deportation of hundreds of illegal alien gang members affiliated with MS-13 and Tren de Aragua—two groups now officially designated as terrorist organizations. These deportations were already underway when left-wing activist groups, including the American Civil Liberties Union (ACLU) and the Soros-linked Democracy Forward, launched a legal challenge to halt the process.
Despite the fact that nearly 300 gang members had already been flown out of the country and landed in El Salvador, Judge Boasberg issued a temporary restraining order blocking further deportations under the Alien Enemies Act.
Rep. Gill Fires Back
Rep. Gill took to X (formerly Twitter) to announce that he was introducing Articles of Impeachment against Boasberg, calling his ruling both “illegal and unconstitutional.” He accused the judge of overstepping his authority in an attempt to stall Trump’s immigration enforcement agenda.
“The purpose of Judge Boasberg’s unconstitutional ruling is to tie up President Trump’s time and resources in litigation, stopping him from executing on the democratic mandate voters gave him,” Gill wrote. “The ruling is a fundamental attack on our democratic system.”
Gill went on to say that Boasberg’s order, which forced deportation flights to turn around midair, was equivalent to a judge trying to command U.S. military operations abroad.
“Judge Boasberg directing deportation flights to turn around midair and return to the United States is tantamount to a Circuit Court Judge directing troop movements abroad or directing the Executive how to conduct foreign policy. It’s illegal and unconstitutional. Time to impeach.”
White House Responds
White House Press Secretary Karoline Leavitt also condemned the ruling, calling it an outrageous attempt by an activist judge to interfere with national security and border enforcement.
“A single judge in a single city cannot direct the movements of an aircraft carrier full of foreign alien terrorists who were physically expelled from U.S. soil,” Leavitt stated.
She further explained that the Supreme Court has consistently ruled that federal courts have no authority over the president’s foreign affairs powers, especially when it comes to enforcing immigration laws, national security measures, and repelling invasions.
“… the Supreme Court has repeatedly made clear,” Leavitt said, “— federal courts generally have no jurisdiction over the President’s conduct of foreign affairs, his authorities under the Alien Enemies Act, and his core Article II powers to remove foreign alien terrorists from U.S. soil and repel a declared invasion.”
Impeaching a federal judge is no small feat, but Gill is determined to push forward. The last time a federal judge was impeached and convicted by the Senate was in 2010, when G. Thomas Porteous, Jr., a Clinton appointee, was removed from office for accepting bribes and lying under oath.
Gill’s call for impeachment sends a strong message that rogue judges who put political activism above the law will not go unchallenged. As Trump continues his crackdown on illegal immigration and gang violence, expect more legal battles ahead. But with Republican leadership standing firm, the fight for secure borders and the rule of law is far from over.
